2.1. Restriction on Unauthorized Use by Third Parties and E-Commerce Sellers
Chordia’s Inc., being the exclusive and lawful proprietor of multiple registered intellectual property rights under Indian law, hereby issues this notice of restriction and enforcement to all third parties, including individuals, resellers, sole proprietors, distributors, and online marketplace vendors. The firm owns registered trademarks duly protected under the Trade Marks Act, 1999 as mentioned above, along with artistic, photographic, and literary works as mentioned above registered under the Copyright Act, 1957. Accordingly, any third party is strictly prohibited from listing, advertising, repackaging, relabeling, or promoting products of Chordia’s Inc. by representing themselves falsely as manufacturers, creators, brand owners, or source of origin. No person shall affix, emboss, imprint, or overlay any third-party trademark, QR code, label, sticker, seller identity, or false attribution on Chordia’s goods, packaging, or marketing materials. Unauthorized use of Chordia’s trademarks, visual design, slogan, artwork, product descriptions, catalogue format, brand layout, or product photographs—whether wholly or in part—is deemed a violation of statutory rights under the Trade Marks Act, 1999, and the Copyright Act, 1957.
Further, Chordia’s Inc. retains the right to restrain the use of deceptively similar marks even without registration in cases of passing off. Any unauthorized reproduction, imitation, adaptation, or commercial exploitation of such designs—whether in identical or substantially similar form, or under any alternative trade name, seller identity, or misattributed authorship—shall constitute actionable infringement. Chordia’s Inc. reserves full legal recourse to initiate proceedings against such infringing acts under the applicable law, notwithstanding non-registration under the Designs Act.
